First 4-way swap in India breaks legal barrier. In July 2026, eight people from Nagaland, Kashmir, Punjab and Bihar became part of India’s first four-way kidney swap. Four donors gave to four recipients — none of them related. The chain saved four lives.

The difficulty was legal. Under the Transplantation of Human Organs Act, 1994, a donor can only give to a recipient they are related to.

A two-way swap is allowed. But a four-way swap wasn’t explicitly permitted.The eight patients were brought together by a transplant team. All pairs were biologically incompatible with their intended donor due to blood group or cross-match issues. But across the group, matches existed: Donor A could give to Recipient B, B to C, C to D, and D to A.

The hospitals approached the Authorization Committee, which rejected the proposal citing Section 9(3A) allows only two-way swaps. The families then filed a writ petition in Delhi High Court.

On May 26, 2026, the High Court set aside the order and allowed the swap. The court held that Section 9(3A) was illustrative, not restrictive. On July 18, 2026, the surgeries were done in a choreographed chain across 5 operating theatres.

Dr Anant Kumar, who led the operation, said: “We have tried three-way swaps manually, but matching donors with unrelated recipients is very tedious.” A four-way exchange creates more possibilities and reduces waiting time.

The case exposes a gap between medical science and law. As swap transplants grow, the law needs to catch up. For the eight families from different states, the ruling meant life. For India’s transplant system, it’s a precedent that could enable larger chains in the future.
