Green Light, Short Fuse

Supreme Court permits certified green crackers for two days in Delhi-NCR on Nov 7-8, calling bursting a religious practice but warning degradation defeats festivity itself.

The Supreme Court did what no government could give Delhi a conditional yes to firecrackers.

On Monday, Justices M.M. Sundresh and Prasanna B. Varale held that bursting crackers during Deepavali is a religious practice, but one that is qualified under Article 25(1) by public order, health and Article 21's right to a pollution-free life. It therefore allowed only green crackers certified by CSIR-NEERI and PESO, from 6-7 am and 8-10 pm on Nov 7 and 8, after which the complete ban resumes.

The order is surgical. No 'ladis', no garlands, mandatory QR codes, sealed boxes, no mixing with conventional barium crackers. No-cracker zones within 300m of hospitals, nursing homes, old age homes, silence zones and educational institutions — to be marked on on ground and published. Traders whose licences were cancelled get temporary restoration Nov 4-6, but must furnish a "handsome" monetary security.

The Bench was scathing: State has "utterly failed" to enforce bans since 2015. It cited Skanda Purana and Padma Purana - ancient Deepavali used only lamps, crackers came with gunpowder centuries later. Today, microscopic PM enters human body to cause "substantial damage", with children, elderly and disabled most vulnerable.

But will it work? Our ground check in Sadar Bazar and Jama Masjid Monday shows the gap between order and bazaar. Vendors hid banned stock under black polythene beneath green boxes, quoting higher prices, insisting on cash. Police admitted visual distinction is impossible without lab test. North District police seized 1,200 kg in 10 days, 10 cases under Explosives Act - a drop in Delhi's grey market.

Analytically, the court is balancing symbolism and air. Green crackers still pollute, but 30% less. The 4-hour window is meant to preserve sentiment without repeating 2024's AQI 900 nightmare. For India, where festivals are emotional infrastructure, outright bans fail. Regulated allowance plus QR traceability is the pragmatic middle path.
