Stricter Visa Rules Attracts New Crisis

Filings for Green Cards and permanent employment have been halted for several companies in the US, including Cognizant, a major player in the Indian IT sector. This move by the US Department of Labour—taken amidst a sweeping investigation into visa fraud and labour regulation violations—is viewed as extremely serious. This harsh decision by the US comes as a massive blow to the hundreds of thousands of foreign IT professionals who had long hoped to realize the "American Dream" and settle there permanently.

The primary reasons behind this US government action are the protection of the domestic labour market and the curbing of alleged abuses of the visa system. US officials allege that certain large tech and outsourcing companies exploit loopholes in H-1B and Green Card regulations to hire foreign workers at lower wages, thereby undermining employment opportunities for US citizens. What began as an investigation into fraud has now placed the entire tech industry and its corporate filing systems under intense scrutiny.

For the Indian IT sector, this decision represents a major crisis. Major Indian tech firms—such as TCS, Infosys, Wipro, and Cognizant—routinely send large numbers of engineers to the US to work on client projects. The freeze on Green Card filings and the imposition of rigorous background checks will make it increasingly difficult for these companies to manage key US projects and retain highly skilled personnel. Furthermore, this will significantly drive up operational costs and legal compliance expenses.

Perhaps the most distressing human impact of this decision falls on employees already residing in the US. Many Indian engineers have been living in the country with their families for years, caught in the lengthy Green Card backlog. The suspension of filings implies delays in work permit renewals and leaves the future of their children in a state of uncertainty. Due to this climate of uncertainty, many talented professionals are now being compelled to consider leaving the US for Europe or Canada, or returning to India.

This trend clearly indicates that the global tech landscape is shifting. The tightening of US policies could ultimately harm American tech companies themselves, as they will struggle to easily access high-skilled talent. A significant future consequence of this crisis could be that Indian IT companies expand 'work-from-India' models or Global Capability Centers (GCCs) instead of operating on US soil, thereby opening up new avenues for high-level technical jobs within India.
